Terms & Conditions 

Legal & Professional Duties & Responsibilities

 

I will comply with the Rules and Regulations imposed on the profession which provide a protocol for the way in which notaries work and conduct themselves. I am insured under a professional indemnity policy for at least £1,000,000.00. The Notaries Accounts Rules 1989 will be observed.

 

I will remain impartial and independent. Notaries owe a duty first and foremost to the transaction itself. All dealings will remain confidential (although notaries are subject to the general laws relating to money laundering and terrorism). I will keep full and detailed records of your matter.

 

Conditions of our Contract/Terms of Business

 

Due to the nature of the work there will not be a formal written contract. The contract is created when I accept your instructions. The meaning and limits of your instructions will be discussed at our first meeting.  I will provide a proper professional service. It is essential you give me clear instructions and have an exact picture of what it is you wish to achieve.

 

My fees will be agreed in our initial discussions by telephone or email. Documents will not be released until fees are paid in full.

 

Any funds will be held in accordance with the Notaries Accounts and Practice Rules. Notaries have to comply with money laundering regulations and may need to see evidence of your source of funds. 

 

Our contract may be bought to an end if you are unable to provide clear instructions, if fraud or violence are involved or if a bill is not paid.

 

Please note I will not be liable for any unusual loss (to be discussed at our first meeting). The contract between us will incorporate the above terms.

 

As I store personal data I previously complied with the Data Protection Act 1998 and now comply with the General Data Protection Regulation (GDPR). I am registered with the Information Commission.

The indemnity set out in paragraph 5 of my Data Protection Privacy Notice and the warranties referred to in paragraph 8 the Privacy Notice are incorporated into these Conditions of our Contract. For ease the paragraphs are recited separately on the webpage headed “Contractual Paragraphs 5 & 8 of Privacy Notice”.

 

I do not advise on foreign law but act in an evidential, authentication capacity.  I only advise you as to the formalities required for completing the document(s). It is recommended that you seek advice from your own relevant foreign lawyers or other suitable competent advisers.

Disbursements 

You will be advised of any disbursements at the outset and the figures given will be up-to-date at the time of our discussions. The disbursements are from other suppliers. I pass on the exact amount of their costs to you.

 

I act as your agent for these purposes. If the cost of their services increase during our contract that increase will be passed on to you and you will be responsible for any increases in fees.

 

I have no control over the Embassies & Consulates and should they consider a document to fall within a higher fee scale than those we discussed those increased fees will be your responsibility and it will be for you to have any discussions with the Embassy or Consulate direct if you wish to pursue the matter with them.
